HON'BLE SRI JUSTICE S.V. BHATT W.P.No.6286 OF 2015 ORDER:

The petitioners pray for the following relief: ".....this Hon'ble Court may be pleased to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of 4th respondent and his authorities in interfering with the possession of the assigned lands in Sy.No.272/2 to an extent of Ac.1-90 cents and in Sy.No.198 to an extent of Ac.3.00 cents of the first petitioner and Sy.No.272/3 to an extent Ac.5-00 cents of the second petitioner situated at Ravipadu Village, Vinjamur Mandal, S.P.S.R.Nellore District without cancellation of Assignments Pattas of the petitioners and without following due procedure laid down under Andhra Pradesh Assigned Lands (POT) Act, 1977 is highly arbitrary, bad and illegal and to pass such other order or orders..........."

On 12.06.2015, possession of petitioners is protected by this Court by granting interim order. The interim order is subsisting. The Assistant Government Pleader (Assignment), having regard to the stand taken in the counter affidavit, submits that the writ petition can be disposed of by making the interim order as final order and the Tahsildar if intends to proceed against the subject matter of the writ petition will issue notice to petitioners, receive explanation, afford opportunity and pass orders. The statement is placed on record.

The writ petition is disposed of by making the interim order as final order and it is made clear that the respondents if intend to proceed against the subject matter, the same shall be in accordance with law. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
