HONOURABLE JUSTICE G.SRI DEVI CRIMINAL PETITION NO.3594 OF 2021 O R D E R:

1. This Criminal Petition is filed under Section 482 of Cr.P.C., seeking to quash the F.I.R. No.181 of 2021 before Jagadgirigutta Police Station, registered against the petitioner for the offences punishable under Sections 498-A,I.P.C., and Sections 3 & 4 of Dowry Prohibition Act.

2. Though the learned counsel for the petitioner filed the present petition for quashing the the investigation in the above said Crime, he restricts his prayher seeking a direction to the Investigating Agency to follow the procedure prescribed under Section 41-A Cr.P.C., and the guidelines prescribed by the Apex Court in ARNESH KUMAR VS. STATE OF BIHAR AND ANOTHER1

3. Learned Assistant Public Prosecutor would submit that the directions of the Apex Court have to be followed and implemented.

4. In that view of the matter, the Criminal Petition is disposed of directing the police to follow the procedure prescribed under Section 41-A Cr.P.C., and the guidelines issued by the Apex Court as set out in Arnesh Kumar case (Supra).

5. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
