HON'BLE SRI JUSTICE S.V.BHATT W.P.No.36002 OF 2016 ORDER:

Heard Mr. K.Srinivas for petitioner and Government Pleader for Civil Supplies.

The petitioner challenges notification No.1067/ E/ 2016 dated 06.10.2016, as illegal, arbitrary and contrary to G.O.Ms.No.4 dated 28.02.2014.

At request of learned Government Pleader, the writ petition has been adjourned from 25.10.2016 to today.

The Government Pleader, on instructions, makes a statement that the petitioner has not applied for consideration of his case in terms of G.O.Ms.No.4. The 2nd respondent, it is stated, is ready to consider the request of petitioner for appointment as F.P. Shop Dealer in terms of G.O.Ms.No.4 provided an application is made. He further submits that the petitioner is an ex-army man and while considering his case, the view taken by this Court in W.P.No24816 of 2015 will be kept in mind. The statement is placed on record and I am satisfied that the writ petition can be disposed of by this order. The petitioner is given two weeks time from today to apply to 2nd respondent for consideration of his case for appointment as F.P. Shop Dealer under G.O.Ms.No.4 dated 28.02.2014. The 2nd respondent, on receipt of application, is directed to pass orders within four weeks thereafter by keeping in mind the observations of this Court in W.P.No.24816 of 2015.

Till a decision is taken and communicated, the steps initiated through notification shall not be given effect to. The writ petition is disposed of accordingly. No order as to costs.
