THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8395 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an order / direction or any appropriate writ more particularly one in the nature of Writ of Mandamus declaring the action of respondents in recovering an amount of Rs.2,281/- every month from petitioner's salary since November, 2014 towards alleged payment of 20 years active service increment and Grade-I Driver Increment without issuing any notice as illegal, unjust and in violation of principles of natural justice and Articles 21 & 300-A of the Constitution of India and consequently direct the respondents herein to refund the recovered amount with interest and fix the pay by adding two special increments i.e. i) for 20 years active service w.e.f. 01.08.2010 & ii) Grade-I Driver Increment w.e.f. 01.07.2010 and pay the arrears and pass such other order/s as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. Heard Sri Jithender Rao Veeramalla, learned counsel, appearing for the petitioner and Sir N.Vasudeva Reddy, learned standing counsel, appearing for the respondents.

When the matter is called, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 27.07.2015 to the 2nd respondent herein and the same may be directed to disposed of, in accordance with law, by fixing some timeframe. The said request is not opposed by the other side.

4. For the aforesaid reasons, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and

entitlement of the petitioner, directing the 2nd respondent to pass appropriate orders on the representation dated 27.07.2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
