HON'BLE SRI JUSTICE U.DURGA PRASAD RAO I.A.No.2 of 2018 in Crl.P.No.2913 of 2018 and Crl.P.No.2913 of 2018 COMMON ORDER:

The defacto complainant represented by Sri Kaparthi Mohan, who is her father-cum-GPA (GPA dated 04.01.2018) and her counsel Sri Vinjamuri Babu, are present. Accused Nos.1 to 4 and their counsel Sri G.Shashidhar Reddy, are present. Both the parties are identified by their respective counsel.

2) Heard both sides and perused the petitions.

3) On the complaint lodged by the defacto complainant, the Police of Uppal PS, Cyberabad, registered a case in Crime No.972/2015 and after investigation laid charge sheet against A.1 to A.4 for the offences under Sections 498 (A) IPC and Sections 3 & 4 of D.P. Act. The learned III Metropolitan Magistrate, Cyberabad, at L.B.Nagar, has taken cognizance and registered the same as C.C.No.137 of 2016. 4) The defacto complainant and A.1 are the husband and wife. It is submitted on their behalf that due to some matrimonial disputes, the complaint was filed by the defacto complainant. However, pending the litigation, due to the intervention of elders both parties have amicably resolved their disputes and entered into a compromise and hence the compromise may be recorded and proceedings in C.C.No.137 of 2016 on the file of the III Metropolitan Magistrate,

Ranga Reddy District, at L.B.Nagar, may be quashed in the interest of justice.

5) Having regard to the above said submission and considering the fact that it is a matrimonial matter and parties have amicably settled the disputes among themselves, and no purpose will be served even if the parties are driven to trial and following the decision reported in Gian Singh v. State of Punjab and another1, I.A.No.2 of 2018 is allowed and the parties are permitted to compound the offences involved in C.C.No.137 of 2016 on the file of the III Metropolitan Magistrate, Ranga Reddy District, at L.B.Nagar. Consequently, the Criminal Petition No.2913 of 2018 is allowed and the proceedings against A.1 to A.4 in the said C.C.No.137 of 2016 are quashed and accordingly, they are acquitted.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
