HON'BLE SRI JUSTICE U. DURGA PRASAD RAO TRANSFER CRIMINAL PETITION No.243 of 2013 ORDER :

This transfer petition is filed by the petitioner/respondent, praying to transfer F.C.M.C.No.31 of 2011 from the file of Judge, Family Court, Kurnool to Hyderabad.

2. Respondents are contesting the petition.

3. Today, when the matter came up for hearing, learned counsel for both sides submitted that the connected matters between the same parties i.e. C.C.No.277 of 2011 which was pending on the file of Judicial Magistrate of First Class, Dhone and D.V.C.No.26 of 2011 originally pending on the file of Judicial Magistrate of First Class, Kurnool, were transferred to III Metropolitan Magistrate, Nampally, Hyderabad, as per orders of the High Court in Transfer Criminal Petition Nos.150 of 2013 and 127 of 2013 respectively and both the above matters are now pending before the learned III Metropolitan Magistrate, Nampally, and in view of the same, this matter, which is a maintenance case, may also be withdrawn from Family Court, Kurnool and transferred to III Metropolitan Magistrate, Nampally for convenience of all the parties concerned.

4. Having regard to the above submission of both

sides, this petition is allowed and F.C.M.C.No.31 of 2011 pending on the file of Judge, Family Court, Kurnool, is withdrawn and transferred to the Court of III Metropolitan Magistrate, Nampally, Hyderabad, for disposal according to law.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
