THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7818 of 2018 O R D E R:

This writ petition is filed for the following relief: "... to issue a Writ of Certiorari calling for entire records connected to Notification No F/402/2018 dt:19.02.2018 issued by the 3rd respondent thereby inviting applications for appointment of Fair Price Shop Dealer for Shop No 0854036 situated in Chevuru Village Gudlur Mandal Prakasam District and reserved the said Fair Price Shop to Schedule Tribe (ST) as illegal irregular arbitrary violative of G.O.Ms.No.4, dt:19.02.2011 violative of provisions of Essential Commodities Act 1955 and offends Articles 14 ,16 and 21 of Constitution of India and consequently set aside the notification No F/402/2018 dt:19.02.2018 issued by the 3rd respondent and continue the petitioner as Fair Price Shop Dealer for the said Fair Price Shop..."

When the matter is called, it is represented by the learned counsel for the petitioner as well as learned Government Pleader for Civil Supplies that today, in similar circumstances, this Court disposed of W.P.No.7499 of 2018, operative portion of which reads as under:

"In the circumstances, the writ petition fails and is, accordingly dismissed. However, it is made clear that the petitioner may be continued to discharge the functions till fresh appointment is made."

Following the above said order and for the reasons recorded therein, this writ petition is also dismissed. However, it is

made clear that the petitioner may be continued to discharge her functions as fair price shop dealer till fresh appointment is made. Miscellaneous petitions, if any, pending shall stand dismissed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:14.03.2018 kdl
