Subhash Reddy) It is brought to the notice of this Court that C.M.A.No.2839 of 2003 filed between the same parties was ended in dismissal on the representation made by the learned counsel for appellant that the sole respondent died.

We have perused the aforesaid judgment. Even in this appeal, the parties are similar as in C.M.A.No.2839 of 2003.

In view of the aforesaid judgment of this Court, this appeal is also dismissed as infructuous. Miscellaneous Petitions, if any, pending in this appeal shall stand closed. No costs.
