HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.4440 OF 2014 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioners seeking to declare the inaction of respondent Nos.2 and 3 in seeking to dispossess the petitioners from Plot Nos.109, 110, 111, 112, 117, 118, 119 and 120 admeasuring 12 ankanams each in survey No.911/2 situated at Musunur Village, Kavali Mandal, SPSR Nellore District, without considering the representations of the petitioners submitted on 29.07.2005, 19.03.2012 and 11.01.2013, as illegal and arbitrary. Heard the learned counsel for the petitioners as well as the learned Government Pleader for Revenue for respondents. With their consent the Writ Petition is disposed of at the admission stage itself.

Learned counsel for the petitioner, across the Bar, submits that the Joint Collector has recommended for allotment of plots in favour of the petitioners.

That being the position, the petitioners shall make a fresh application seeking appropriate relief before appropriate authority within a period of ten days from today, in which event, the same shall be dealt with at the earliest, preferably within a period of four weeks from the date of filing of such application, after hearing the petitioners, in accordance with law. Status quo as on today shall be maintained with regard to subject property in all respects for a period of six weeks.

Accordingly, the Writ Petition is disposed of. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. There shall be no order as to costs. ________________________ C. PRAVEEN KUMAR, J Date: 24.11.2016 sur
