ORDER
This writ petition is filed challenging the action of the respondents in interfering with the property of the petitioners bearing H.No.4-3/1 in R.S.No.4/2A, 4/2B in an extent of Ac.0.03 cents situated at Iragavaram Village & Mandal, West Godavari District.
The grievance of the petitioners is that the 3rd respondent, who is not connected with Iragavaram Gram Panchayat, is interfering with their property.
Now, the 3rd respondent filed a counter-affidavit stating as follows:
"It is relevant to submit here that the petitioners in spite of they being residents of Iragavaram Village has occupied the land to an extent of Ac.0.03 cents situated in Sy.No.89A belongs to Rapaka Grampanchayat in Rapaka Village. This respondent after noticing the same, has informed the petitioners to remove the cattle shed in the Rapaka Village and accordingly, they removed the same three months back itself. Except the said issue, there is nothing between this respondent and the petitioners herein. This respondent has nothing to do with the petitioner's property situated in another village. It is relevant to state here that after this respondent came to know about the filing of writ petition, has obtained
adangal copies to the property so mentioned by the petitioner herein in the subject writ petition. The petitioner herein at para 3 of the writ affidavit has categorically stated that he is having a house bearing No.4-3/1 in R.S.No.4/2A and 4/2B in an extent of Ac.0.03 cents situated within the limits of Iragavaram Grampanchayat. In fact in the Iragavaram Village to the land in Sy.No.4/2 it is in the name of Pala family as per adangal, but whereas the land in Sy.No.4/2A and 4/2B i.e., the property mentioned by the petitioner herein is situated in Ogidi village."
In view of the said averments made by the 3rd respondent, no further orders are necessary in the present writ petition. Accordingly, the Writ Petition is closed. No costs.
