THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.2910 of 2018 ORDER:

This Criminal Petition under Section 438 Cr.P.C is filed by the petitioner/ A.1 to enlarge the petitioner on bail in the event of his arrest in Cr.No.19 of 2018 of I Town Police Station, Nellore, registered for the offences punishable under Sections 3,4,5 and 7 of ITP ( Prevention Act). The petitioner is Acc used No.1, who is allegedly running brothel house.

After arguing the matter for awhile, the learned counsel for the petitioner requested this Court to permit the petitioner to surrender before the Court having jurisdiction over the area and file an application under Sections 437 and 439 Cr.P.C.

Acceding to the request of the learned counsel for the petitioner, the petitioner is permitted to surrender before the Court having jurisdiction over the area and if any application is filed under Sections 437 and 439 Cr.P.C by the petitioner, the Magistrate concerned is directed to dispose of the application, in accordance with law, after affording an opportunity to the Public Prosecutor.

With the above observation, this Criminal Petition is disposed of. Miscellaneous Petition, if any pending, in this case, shall stand dismissed.
