THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9429 OF 2019 O R D E R:
To declare the inaction of the respondent authorities on the Application and the legal notice got issued by the petitioner as illegal and arbitrary, the petitioner filed this Writ Petition. The case of the petitioner is that himself and his brother had partitioned certain property vide document No. 3534 of 2011, dated 10.06.2011, in which, he got the property bearing H. No. 11-15-36 situated at Kashibugga Area, Warangal City, admeasuring in all 325.25 square yards. However, the respondent authorities had made a tax demand for the entire joint property. In that context, the petitioner asserts that he got issued the legal notice dated 08.01.2019 with a request to rectify the defect and issue a fresh demand to the property owned by him. Heard learned counsel for the petitioner.
Learned Standing Counsel for the Corporation submits that the request of the petitioner would be considered and the property tax would be worked out and a further demand would be issued. In the light of the submission made by the learned Standing Counsel, the Writ Petition is disposed of with a direction to the respondent to issue a fresh demand duly rectifying the mistake. Till such time, the demand issued earlier shall not be enforced. No costs.
Consequently, the miscellaneous Applications, if any shall stand closed.
