HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 29763 of 2011 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader for the respondents. With the consent of both the parties, the Writ Petition is disposed of at the stage of admission.

The present Writ Petition is filed questioning the action of the respondent in not issuing 'No objection certificate' in respect of the land in Sy.No.371 to an extent of Ac.5.80 cents of Alamuru village, Anantapur Mandal and District, as illegal and arbitrary and violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents to consider the representation dated 30.09.2011 made by the petitioner for issuance of 'No objection Certificate' to the above said land.

Learned Government Pleader for respondents filed counter stating that no such representation was made to them and that if any such representation is made they will consider the same at the earliest.

Having regard to the above circumstances of the case and without going into the merits of the case, the Writ Petition is disposed of directing the petitioner to make an

application afresh, seeking no objection certificate to the 3rd respondent/The Tahasildar, Anantapur, Anantapur District within six weeks from today, in which event the 3rd respondent shall consider the same and pass orders in accordance with law, within six weeks thereafter. Accordingly, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, in this Writ Petition, shall stand closed.
