THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.438 OF 2016 ORDER:

This Criminal Revision Case is filed by the accused No.1 challenging the order of the II AJCJ-cum-XIX Metropolitan Magistrate, Cyberabad, Kukatpally at Miyapur dated 1.02.2016 whereby the learned Judge while returning the passport to the petitioner imposed a condition to appear before the Court on every date of hearing till the disposal of the case. On perusal of the material it is evident that the passport is returned to the petitioner since he is working in a bank at Dubai. In view of the same, the condition imposed on the petitioner to appear before the trial Court on every date of hearing till the disposal of the case is not justified.

In the circumstances, the presence of the petitioner before the trial Court is dispensed with. However, the petitioner is directed to be represented by a counsel on all hearing dates. The Criminal Revision Case is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
