Fahmeeda Fatima v. The State Of Telangana
HON'BLE Dr.JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION No.3474 of 2023 ORDER:
1.
Heard Sri Mohammed Islamuddin Ansari, learned counsel for the petitioner as well as the learned Additional Public Prosecutor who is representing the RespondentState. 2.
This Criminal Petition is filed seeking the Court to relax the condition that was imposed upon the petitioner while enlarging her on bail through orders dated 13.01.2023 in Crl.M.P.No.5089 of 2022, by the Court of I Additional Metropolitan Sessions Judge, Hyderabad. 3.
Learned counsel for the petitioner states that the petitioner is arrayed as Accused No.4 in Crime No.736 of 2022 of Chandrayangutta Police Station, Hyderabad, and the petitioner was granted bail. But, she was directed to appear before the Station House Officer, Chandrayuangutta Police Station, Hyderabad, on every Sunday between 10.00 AM and 12.00 Noon for a period of six months or till filing of charge sheet whichever is earlier and the petitioner is complying the condition since three
months and therefore, the condition imposed may be relaxed.
4.
The submission of the learned Additional Public prosecutor is that investigation is completed and charge sheet would be laid soon.
5.
The facts that are glaring against the petitioner are that the petitioner was found in possession of 4 grams of Mephedrone Drug and the same was recovered from the possession of the petitioner.
6.
Having regard to the gravity in the allegations levelled, the condition imposed by the Sessions Court appears reasonable. Also, on filing of charge sheet, the petitioner need not appear before the concerned Police or in case charge sheet is not filed within six months from the date of the bail order, she need not comply the condition. Therefore, this Court is of the view that the relaxation of bail condition, as of now, is undesirable.
7.
Resultantly, the Criminal Petition stands dismissed. Learned counsel for the petitioner while parting with this order states that 'Eid' is falling on this Sunday i.e. on
23.04.2023 and the petitioner has to perform the festival and therefore, the petitioner may be exempted from appearing before the concerned Police atleast for the said day.
8.
Having regard to the justifiable cause shown, the petitioner is relaxed from attending the concerned Police on 23.04.2023.
9.
Miscellaneous petitions pending, if any, shall stand closed.
