O R D E R:- This writ petition is filed to declare the action of respondent Nos.2 and 3 in threatening to demolish the houses of the petitioners in Government land in Sy.No.64/17 and 18 of Pedagantyada, Visakhapatnam while the applications of the petitioners for regularization are pending before the 4th respondent without issuing any notice, as illegal, arbitrary, violative of principles of natural justice and contrary to Articles 14 and 21 of the Constitution of India and consequently direct the respondents not to interfere with the houses of the petitioners in Sy.No. 64//17 and 18 of Pedagantyada, Visakhapatnam District which are covered by regularization application Nos.VZG 1001-5072581, dated 04.04.2016, VIZG 1001-50-72670 dated 08.04.2016, VZG1001-50-72669, dated 08.04.2016 made by the petitioners.
During hearing, Sri S. Laxminarayana, learned Standing Counsel for Greater Visakhapatnam Municipal
Corporation appearing for respondent Nos.2 and 3 has admitted that they are not going to demolish the houses belonging to the petitioners without following due process of law.
Hence, respondent Nos.2 and 3 are directed not to demolish the houses of the petitioners in Sy.No. 64/17 and 18 without following the due process of law. With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel to the disposal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
