HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE WRIT PETITION No. 18036 OF 2009 ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard Sri G. Sravan Kumar, learned counsel holding for Sri O. Manohar Reddy, advocate on record for the petitioner. This writ petition was filed in 2009 for the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the 3rd Respondent in holding that "the holder of HGV Transport licence is not authorized to drive a heavy passenger vehicle"

vide proceedings Memo No.007127/A/HC/2009 dated 20.07.2009 as illegal, arbitrary and contrary to the provisions of Sec.10(2)(E) of the Motor Vehicles Act, 1988 and consequently direct the 5th Respondent to process the claim application No.050504/31/08/01/90000063 of the Petitioner and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

This Court did not pass any interim order while issuing Rule. As a matter of fact, on 27-11-2009, none appeared for the parties and the Court issued Rule. The petitioner never bothered to seek or claim any relief. In view thereof, learned counsel for the respondents submits that the petition has rendered infructuous. Learned counsel for the petitioner could not and did not dispute the submission made by learned counsel for the respondents, apart from the fact that he is not getting any instructions.
