HONOURABLE SRI JUSTICE P.KESHAVA RAO W.P.No.6424 of 2013 ORDER:

Heard learned counsel for the petitioner as well as learned Government Pleader for Home appearing for respondent Nos.1, 2 and 4.

The prayer sought in this Writ Petition is as under: "... to issue order or orders more particularly one in the nature of writ of Mandamus declaring the inaction of respondent Nos.1 and 2 in considering the compliant dated 23.02.2013 of the petitioner as illegal, arbitrary and in violation of Articles 14 and 21 of the Constitution of India and also in violation of SCs & STs (POA) Act and to pass such other order or orders this Hon'ble Court deems fit and proper in the circumstances of the case in the interest of justice."

During the course of hearing, learned Government Pleader for Home brought to the notice of this Court that the complaint said to have been made by the petitioner to respondent No.1 is not received either in the office of respondent No.1 or respondent No.2. A perusal of the material papers filed by the petitioner along with the Writ Petition reveals that no proof of acknowledgment of the said complaint is filed therewith.

Learned Government Pleader for Home fairly submits that if the petitioner submits a fresh complaint/representation to respondent Nos.1 and 2, appropriate action will be taken as per law. In these circumstances, the petitioner is given liberty to submit a fresh complaint/representation to respondent Nos.1 and 2 ventilating his grievances. Upon receipt of the same, respondent Nos.1 and 2 are directed to take appropriate action as per law.

Subject to the above observation, the Writ Petition is disposed of.

As a sequel, the Miscellaneous Petitions pending, if any, shall also stand dismissed. No order as to costs.
