THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NOS.2495 OF 2022 AND COMMON ORDER:
These two Criminal Petitions are filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") by the petitioners, who are figured as Accused Nos.2 to 5 seeking to enlarge them on bail in connection with Crime No.390 of 2021 on the file of Station House Officer, Kodad Town Police Station, Suryapet District registered for the offences punishable under Sections 8(C) read with Section 20(b)(ii)(C) & 22 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the NDPS Act').

As the petitioners are Accused Nos.2 to 5 in Crime No.390 of 2021, the criminal petitions are disposed off under common order. 3.
Heard the learned counsels for the petitioners and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that on 14.11.2021 the police noticed these petitioners who tried to escape and immediately apprehended them. On search they found 1.5 kgs of Hashish oil from each of the petitioner.

The petitioner/Accused No.5 is a student and so is petitioner/Accused No.4.

It is submitted by the learned Assistant Public Prosecutor that petitioners/Accused Nos.2 to 4 are involved in another crime of similar in nature, however, there are no criminal antecedents as against petitioner/Accused No.5.

Accordingly, the Criminal Petition No.1833 of 2022 is allowed and in view of earlier case pending against petitioners/Accused Nos.2 to 4, the Criminal Petition No.2495 of 2022 is dismissed. Hence, the petitioner/Accused No.5 is granted bail subject to the following conditions:
i) The petitioner/Accused No.5 shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties
for a like sum each to the satisfaction of I Additional Sessions Judge, Nalgonda.
ii) The petitioner/Accused No.5 shall appear before the Station House Officer, Kodad Town Police Station on every Tuesday and Friday between 10.00 am and 01.00 PM for a period of three months.
iii) The petitioner/Accused No.5 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 8.
As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
