ORDER:

This writ petition is filed alleging inaction on the part of the 3rd respondent in issuing pattadar pass books, inspite of an application made in Form VI by the petitioner, and appropriate directions are sought for in this regard. The instructions of the learned Government Pleader received from 3rd respondent, however, show that there is a dispute pending in an appeal before the Revenue Divisional Officer filed by the cousin brother of the vendor's vendor of the petitioner seeking cancellation of the pattadar pass books and title deeds issued in favour of one Smt. U.Vasumathi.

The petitioner claims title ultimately through the said Vasumathi as vendor's vendor and since the petitioner's application for grant of pattadar pass books is directly connected with the result of the appeal before the Revenue Divisional Officer as mentioned above, the petitioner's application was kept pending awaiting orders in the appeal. Therefore, the direction sought for in this writ petition cannot be given. However the writ petitioner is at a liberty to await the decision in the said appeal or take such other legal steps, if he is so advised, in accordance with law, including impleadment in the appeal, if that is permissible.

The writ petition is accordingly disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
