HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7585 OF 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Public Prosecutor (Andhra Pradesh) for the State before notice to respondent No.2 and before admission. The petitioner is A5 in C.C.No.249 of 2010 on the file of Additional Munsif Magistrate Court, Chirala, Prakasam District, where the learned Magistrate has taken cognizance for the offence punishable under Sections 406, 420, 506 r/w 34 I.P.C. Perused the material on record. As the material falls short for this Court to admit the application, this application is disposed of giving liberty to the petitioner by dispensing with his presence before the Court. Needless to say, if the petitioner files an application under Section 205 Cr.P.C. to represent through special vakalat holder, the learned Magistrate shall hear and permit with necessary conditions of appearance, as and when required.
