The petitioner complains against improper investigation into Cr.No.59/ 2012.

The 2nd respondent filed counter affidavit and the operative portion reads thus:

"A civil dispute is pending over the petition schedule properties filed by the complainant in the District and Sessions Court vide O.S.No.292/11. As the dispute of the petitioner-complainant is purely civil in nature, the investigation officer obtained permission from the SubDivisional Police Officer, Gudur to refer the complaint of the petitioner herein as civil in nature. Investigation was completed. Notice to the complainant-petitioner was served on 15.4.2013. After completion of the investigation, final report U/sec.173 Cr.P.C was also filed before the Hon'ble Court of Judicial Magistrate of First Class at Sullurupet on 16.4.2013. A copy of the final report is filed along with this counter affidavit for the kind perusal of this Hon'ble Court".

As the final report is already filed, the writ prayer is rendered ineffective.

The writ petition is, accordingly, dismissed. There shall be no order as to costs.
