THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.7591 of 2016 ORDER:
The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.34 of 2014 on the file of the Special Judge for trial of ACB cases in Rayalaseema Region at Kurnool, registered for the offences punishable under Sections 7, 12 and 13(2) r/w.Sec.13(1)(d) of the Prevention of Corruption Act, 1988.
Heard the learned counsel appearing for the petitioner/A1 and the learned Additional Public Prosecutor, representing the State. Specific allegations were made in the complaint against the petitioner. The truth or otherwise of the allegations can only be decided during course of trial. This Court is not supposed to make a roving enquiry into the allegations made in the charge sheet. I see no ground to quash the charge sheet. However, after hearing the arguments of the learned counsel for the petitioner/A1 extensively, without going into the merits of the case, it is felt necessary that appropriate direction be given to the Court below for speedy disposal of the case, as it is pending since 2014. Accordingly, the Criminal Petition is disposed of, directing the Court below to dispose of the above calendar case, in accordance with law, as expeditiously as possible, preferably, within a period of 3 (three) months from the date of receipt of a copy of this order.
Pending miscellaneous applications, if any, shall stand closed in consequence.
