HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No:19592 OF 2017 ORDER:
1. This writ petition is filed by the petitioners seeking to direct respondents Nos.1 to 4 to consider their representation and initiate action against respondents Nos.5 to 15 in connection with the unauthorized constructions made in different plots in Sy.No.311 of Garimell Shivar, Mancherial District.
2. It is the case of the petitioners that the vendor of the petitioners and his brothers inherited the joint family agricultural lands in Sy.No.311 and the petitioners' vendor sold his share to the petitioners. The brothers of the petitioners' vendor have got the share in the same survey number and they also sold the lands to the unofficial respondents. The unofficial respondents constructed the buildings in the lands purchased by the petitioners without obtaining any building permission and approved lay out. The petitioners applied for survey and demarcation of the lands. As per the report of the authorities concerned, the respondents made constructions in the lands of the petitioners. The petitioners made a representation to respondents Nos.2 to 4 about the illegal constructions made by the unofficial respondents. The 2nd respondent addressed a letter to the 4th respondent to initiate steps. But the 4th respondent has not taken any steps so far. Hence, the petitioners filed this writ petition.
3. Heard and perused the material available on record.
4. The main grievance of the petitioners is that the official respondents have not considered their representation so far. Considering the
circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, this Court is inclined to pass the following order:
"The official respondents are directed to consider the representation of the petitioners and take appropriate action, as expeditiously as possible, in accordance with law, against the unauthorized constructions, if any made by the unofficial respondents as alleged by the petitioners."
5. Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. _________________ Justice Raja Elango Date: 16th June, 2017 Nn.
