Allwyn Watches Mazdoor Sangh (Reg,No. 2534) v. M/S. Allwyn Watches Ltd., (In Liquidation).
HONOURABLE SRI JUSTICE S.V. BHATT COMPANY APPLICATION No. 198 of 2016 In COMPANY APPLICATION Nos. 1405 and 816 of 2014 In COMPANY PETITION No. 108 of 2001 O R D E R :
This application is filed seeking a direction to the Official Liquidator to adjudicate the claims of the workmen expeditiously. Heard Sri V. Ravinder Rao, learned counsel for the applicant and Sri M. Anil Kumar, learned counsel for the Official Liquidator. This Court, on 18.02.2016 passed the following docket order: "Having regard to a few serious objections raised by Sri V. Ravinder Rao, learned counsel for the applicant, in the conduct of enquiry into the claims filed by the workers of applicant Union before the Official Liquidator, the learned Standing Counsel is not a position to immediately respond. As the case has a chequered and long history, I am of the view that on the next date of hearing, the learned Standing Counsel ensures the presence of Official Liquidator with full data in his laptop to assist the Court.
Post on 02.03.2016."
Today, the Official Liquidator is present in the Court and has placed on record the report dated 01.03.2016 together with Form No.69, Notice of Admission / Rejection of Proof of Debt. Having regard to the fact that Form No.69 is filed by the Official Liquidator, the prayer in the application does not survive. Learned counsel for the applicant requests that liberty may be given to the applicant to canvass grievances/objections, if any, against the adjudication as communicated through Form No.69. The Company Application is accordingly closed granting liberty
as prayed.
