Heard learned counsel for the petitioner and learned Government Pleader for Mines representing the respondents and perused the prayer in the writ petition with supporting affidavit. 2.
The prayer in the writ petition reads as follows: "....... to issue writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of the respondent No.3 in Notice No.3505/(MDI(LR))/VG//V&E-TPT/15, dt.08.03.2016 and the action of Respondent No.2 in not disposing off the Revision Petition filed under Rule 35-A of A.P.Minor Mineral Concession Rules, 1966 in Revision Petition dt.20.08.2016 is arbitrary, illegal, unjust, unconstitutional and in violation of principles of natural justice and Mines and Minerals (Development & Regulation) Act, 1957 and A.P. Minor Mineral Concession Rules, 1966 and pass such other order or orders as the Hon'ble Court deems fit and proper in the interest of justice."

It is the submission that since August 2016, the revision is kept pending without disposal by not even giving dates of hearing by the 1st respondent. The learned Government Pleader submits that they are going to dispose of on merits.

Having regard to the above, the writ petition is allowed directing the 1st respondent to dispose of the revision, on own merits,
after giving notice, fixing the date for hearing for appearance and any submissions by the petitioner, preferably within four weeks form the date of receipt of the order and communicate the order. Miscellaneous petitions pending, if any, shall stand closed. No costs.
