HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.15821 of 2013 ORDER:
This writ petition is filed to declare the action of the respondents in not taking any decision as to renewal of the T.F.T. license of the petitioner at Dharur Village and Mandal, Ranga Reddy District, duly taking into consideration the recommendation made by the local excise officers vide proceedings Cr.No.125/2012/MPR, dated 01.12.2012 as illegal and arbitrary.
The respondents filed their counter stating that a case was booked against the petitioner on 20.3.2013 for illegal sale of toddy without license and seized 54 plastic crates of toddy under cover of panchanama. It is further stated that in the light of the instructions of the Commissioner of Prohibiton and Excise, Hyderabad, vide Cr.No.11565/2012/CPE/E1, dt.24.9.2013, the license of the petitioner has not been renewed and it is deemed to be cancelled as the petitioner was involved in adulteration of toddy with chloral hydrate which is injurious to pubic health and thereby contravened Rule 16 of A.P. Excise (Grant of License to Sell Toddy, Conditions of License and Tapping of Excise Trees) Rules, 2007. Learned counsel for the petitioner seeks permission of this Court to file a fresh representation before the respondents.
In view of the facts and circumstance of the case, the Writ Petition is disposed of giving liberty to the petitioner to file a fresh representation before the respondents. No order as to costs.
