THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.3644 of 2015 ORDER:

The petitioner herein is the plaintiff in O.S.No.2159/2011 on the file of the Court of the learned I Additional Senior Civil Judge, Rangareddy District at L.B.Nagar. The petitioner filed O.S. No.2159/2011 for permanent injunction against the respondent herein. Along with the suit, the petitioner filed I.A. No.1750/2011, and the said application was allowed on 06.01.2012. Against the said order, the respondent herein preferred C.M.A. No.34/2012 on the file of the Court of the learned II Additional District & Sessions Judge, Rangareddy District at L.B.Nagar, which granted interim suspension of the order pending disposal of C.M.A.No.34/2012. Ultimately, the said C.M.A. was allowed on 30.04.2015. In view of the same, the petitioner/plaintiff enjoyed injunction for a period of nearly two months as the suit itself was filed in November 2011. The petitioner is not having any injunction since the filing of C.M.A. No.34/2012 and in that view of the matter, this Court is not inclined to go into the merits of the case as the suit is for permanent injunction.

Without expressing any opinion on merits, the order passed in C.M.A. No.34/2012 dated 30.04.2015 is confirmed, and the learned I Additional Senior Civil Judge, Rangareddy District, is directed to dispose of O.S.No.2159/2011 as expeditiously as possible, but not later than 30.04.2016. Since the parties are represented by the counsel before this Court, the learned counsel are requested to instruct their clients to co-operate with the disposal of the suit within the said date.

Accordingly, this Civil Revision Petition is dismissed. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed.
