HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.7 7 7 6 of 2 0 1 8 ORDER: - Heard learned Counsel appearing for the petitioner and the learned Government Pleader.

The complaint of the petitioner herein is the alleged inaction on the part of the 2nd respondent in acting upon the representation dated 20.02.2018 of the petitioner against the unauthorized construction being carried out by the 3rd respondent in the premises bearing No.1-4-55 admeasuring 252.75 Sq.Yds., situated at Brahmanwada, Narayanakhed Village and Mandal, Sangareddy District. It is the further case of the petitioner that in deviation to the sanctioned plan, the unofficial respondent/ R.3 is undertaking the construction work. On the other hand, it is submitted by the learned Government Pleader, appearing for the respondents No.1 and 2 that after submission of the representation by the petitioner herein, the 2nd respondent issued a notice to the unofficial respondent No.3 herein and in turn, he submitted an explanation saying that he would make the construction work strictly in accordance with the sanctioned plan only.

In view of the above submissions, the Writ Petition is disposed of, permitting the petitioner herein to file an appeal before the concerned authority against the sanctioned plan issued in favour of the unofficial respondent, if he is advised to do so and also with a direction to the 2nd respondent herein to

take action against the 3rd respondent in the event of there being any deviation to the sanctioned plan.
