Petitioners' grievance is that petitioner had made an application seeking correction of his date of birth as "0606-1969" instead of "06-06-1967" in his passport bearing No.B1224549 and when the petitioner sought to make the application for issuance of a fresh passport with correct date of birth as 06-06-1969, the 2nd respondent is not even receiving the said application.

Learned counsel for petitioner placed reliance on the judgment of this Court in Durgempudi Venkata Raghava Vs. Pass Port Officer, Ministry of External Affairs, Pass Port Office, Hyderabad[1] and also orders dt.17-07-2012 in W.P.No.21486 of 2012 and dt.09-07-2012 in W.P.No.16588 of 2012.

Sri B.Appa Rao, learned Standing counsel for 2nd respondent states that the 2nd respondent will entertain the application submitted by petitioner for correction of his date of birth and for issuance of a fresh passport with the

date of birth as 06-06-1969, if it is submitted within two

(02) weeks from the date of receipt of a copy of this order and will then consider the same in accordance with law within eight (08) weeks from the date of receipt of such application; and if the 2nd respondent is not inclined to accept the petitioner's application, he will pass a reasoned order and communicate the same to the petitioner.

In view of the said submission, the Writ Petition is disposed of directing the 2nd respondent to receive the application submitted by petitioner for correction of his date of birth and for issuance of a fresh passport with the date of birth as 06-06-1969, if it is submitted within two

(02) weeks from the date of receipt of a copy of this order and then consider the same in accordance with law within eight (08) weeks from the date of receipt of such application. If the 2nd respondent is not inclined to accept the petitioner's application, he shall pass a reasoned order thereon and communicate the same to the petitioner. No costs.

5. As a sequel, miscellaneous petitions pending if any, in this Writ Petition shall stand closed.
