HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 9538 OF 2019 O R D E R :

This writ petition is filed challenging the action of the Police Authorities in repeatedly calling, harassing and threatening the petitioners, without registering any crime.

Learned Assistant Government Pleader for Home produced written instructions stating that on the complaint of Proprietor of Kakaraparthy Agencies, Khammam, a crime is registered against the petitioner in Crime No.100/2019, under Sections 520, r/w.34 IPC, dt.29.04.2019; and that the investigation is at the initial stage. The contents mentioned in the written instructions forming basis for registration of FIR appears to be civil in nature. But, since the petitioner has not filed this writ petition for quashing of the said crime, the said issue is not dealt with in this writ petition. But, however, after registration of crime, the respondents are bound to follow the procedure under Cr.P.C.

In view of the aforesaid facts and circumstances, the writ petition is disposed of directing the respondent police not to harass or interfere with the life and liberty of the petitioners, except in accordance with law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
