THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7283 of 2016 ORDER:

This petition is filed by the petitioner/A-1 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in Crime No.232 of 2012 of Amalapuram Police Station, East Godavari District, registered for the offences punishable under Sections 364-A, 384, 302, 120(b) read with 34 IPC.

Heard and perused the material available on record. The allegation against the petitioner is that he along with the other accused have kidnapped the deceased and called for ransom and after withdrawing cash from ATM, they have killed the deceased. Learned counsel for the petitioner submits that investigation is completed and charge sheet is also filed and co-accused were also granted bail.

Learned Public Prosecutor opposed the bail application of the petitioner on the ground that the petitioner is a professional criminal and also having some previous cases. The petitioner is also produced before the Court through PT warrant. In the earlier occasion also, the Court dismissed bail applications of the petitioner. Taking into consideration the submissions of the learned Public Prosecutor, in view of the fact that that there is no substantial change of circumstances to consider the bail application of the petitioner at this stage, this Court is not inclined to grant bail to him.
