THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7749 of 2018 ORDER:

In view of the nature of disposal of the present Writ Petition, the notice to respondent Nos.5 and 6 is dispensed with. It is the case of the petitioner that he is the absolute owner and possessor of the agricultural lands in various survey numbers situated at Kothagudem Town and Mandal, Bhadradri Kothagudem District. The petitioner's grandfather was the original pattadar and after his death, the petitioner's father enjoyed the said property. Thereafter, after the demise of his father, the petitioner has been enjoying the same. He submitted an application in Form VI A to the fourth respondent on 03.08.2016 for grant of pattadar pass books and title deeds in his favour. When there was no response, he filed W.P.No.37580 of 2016, which was disposed of on 03.11.

2016 directing the fourth respondent to consider the application of the petitioner and pass orders thereon in accordance with law within a period of two months. In pursuance of the memo dated 01.05.2017 asking the petitioner to approach the fourth respondent with necessary documents, the petitioner submitted his documents on 09.05.2017. Thereafter, no action was taken. Meanwhile, when the revenue officials displayed the revenue records in the notice board at various places, the petitioner came to know that against his land, the revenue officials removed the name of the original pattadar and inserted the names of respondent Nos.5 and 6 in the pattadar and enjoyer column.

As per the averments in the writ affidavit, the official respondents have not considered the application of the petitioner for issuance of pattadar pass books and title deeds in spite of the order of this Court in W.P.No.37580 of 2016. But, the main grievance of the petitioner in this Writ Petition relates to rectification of entries in the revenue records and, according to the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, any person affected by an entry in the record of rights is entitled to apply for rectification of the entries.

Hence, this Writ Petition is disposed of giving liberty to the petitioner to file an application before the fourth respondent as per the provisions of the Telangana Rights in Land and Pattadar Pass Books Act seeking rectification of entries in the revenue records. As and when such an application is filed, it is needless to observe that the fourth respondent shall take up the said application along with the earlier application filed on 03.08.2016 for grant of pattadar pass books and title deeds, issue notice to respondent Nos.5 and 6 and dispose of the same in accordance with law. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
