HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39068 OF 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking the following relief: " ... to issue Writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not considering Form 6 A application submitted by the petitioner dated 11.05.2016 for granting pattadar pass books for the land in Sy No.440/A an extent of Ac.08-38 Gts, Burgumpahad Village, Burgumpahad Mandal, Bhadradri Kothagudem District as arbitrary, illegal and violation of principles of natural justice and provisions of Constitution of India and consequently may direct the Respondents to consider the Petitioner Application No.MU021600739164 dated 11.05.2016 within stipulated period, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.
Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to respondents to consider the application dated 11.05.2016 made by the petitioner.
Learned AGP would submit that the request of the petitioner cannot be considered since the subject land is an assigned land and the petitioner is not the immediate family member.
Having regard to the rival submissions made, the Writ Petition is disposed of directing the 4th respondent to consider the application dated 11.05.2016 made by the petitioner and pass appropriate orders thereon in accordance with law after hearing the petitioner and other aggrieved persons, if any, as early as possible, preferably within a period of three months from the date of receipt of a copy of this order.
