HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.26650 OF 2016 ORDER:- Aggrieved by the proceedings dated 25.04.2016 issued by the 4th respondent-Tahsildar under Section 3 of the A.P. Assigned Lands (Prohibition of Transfers) Act, 1977, the petitioners filed an appeal on 10.05.2016 before the 6th respondent-R.D.O. Initially, the petitioner filed a Writ Petition No.16203 of 2016 before this Court and this Court disposed the same by an order dated 12.05.2016 giving a liberty to the petitioners to file an appeal before the competent authority within a period of 12 weeks and till such time the appeal is filed the proceedings dated 25.04.2016 issued by the 4th respondent were stayed. Thereafter, the petitioner filed an appeal on 10.06.2016 before the 6th respondent-R.D.

O along with a stay petition seeking stay of the impugned proceedings. The grievance of the petitioners is that though the appeal along with the stay petition were filed on 10.06.2016, neither the appeal nor the stay petition were disposed of so far. However, the 4th respondent-Tahsildar is pressurizing the petitioners from vacating the peaceful possession and enjoyment of the land in issue. Considering the fact that it is the assertion of the petitioners that they are in possession and enjoyment of the land in question on account of the acquisition through various sale deeds, there shall be stay of the proceedings dated 25.04.2016, issued by the 4th respondent-Tahsildar till the disposal of the appeal filed by them. In that view of the matte, the writ petition can be disposed of directing the 6th respondent-R.D.

O to dispose of the main appeal dated 10.06.2016 itself filed by the petitioners within a period of 12 weeks from the date of receipt of copy of this order. With the above observations, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall stand closed. ____________________________________ JUSTICE CHALLA KODANDA RAM Date:11.08.2016.
