THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.16524 of 2013 ORDER:

Heard learned counsel for the petitioner as well as learned Government Pleader appearing for the respondents 1 to 4. 2.

The prayer sought in the writ petition is as under:- "... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus by declaring the inaction of the respondents pertaining to deposit of the land attached amount of Rs.64,10,43,125/- to the credit of C.C.No.1 of 2013 on the file of Metropolitan Sessions Judge, Hyderabad as illegal, arbitrary, contrary to G.O.Ms.No.212, dated 12.8.2010 issued by the Respondent No.1 and consequently direct the respondents to forthwith deposit the attached amount of Rs.64,10,43,125/- to the credit of C.C.No.1 of 2013 before the Metropolitan Sessions Judge, Hyderabad and pass such other order orders which this Hon'ble Court may deem fit and proper in the circumstances of the case." 3.

Learned Government Pleader placed on record the written instructions, dated 21.11.2019, issued by the Sub-Inspector of Police, F-Division, CCS, DD, Hyderabad.

From a perusal of the said written instructions, it is revealed that as per the orders of the Hon'ble Supreme Court of India vide Transfer Petition (Crl.) Nos.425 to 440 of 2014 and as per the instructions of the learned Principal Metropolitan Sessions Judge, Hyderabad, vide Dis.No.678/MSJ/Hyd/2016, dated 09.02.2016, the

case record in Crime No.258 of 2009 of CCS, DD, Hyderabad, in C.C.No.1 of 2013 was transferred to the Court of the Principal Sessions Judge, PMLA Special Court, Bombay City & Civil Sessions Court, Greater Bombay, and it is pending trial. 5.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition, since C.C.No.1 of 2013 is already transferred to the Court of the Principal Sessions Judge, PMLA Special Court, Bombay City & Civil Sessions Court, Greater Bombay.

Accordingly, the writ petition is closed. However, liberty is given to the petitioner to approach the learned Principal Sessions Judge, PMLA Special Court, Bombay City & Civil Sessions Court, Greater Bombay, for redressal of his grievances, as per law. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
