SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2926 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A4, A9 and A10, in Crime No.21 of 2018 on the file of I Town Police Station, Nellore, SPSR Nellore District. The offences alleged are under Sections 147, 148, 324, 307 r/w 149 IPC.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The case of the prosecution is that three persons by name Sandeep, Uday, Sagar and some others came and attacked the defacto complainant. The petitioners counsel submits that there are no specific overt acts against these petitioners and that their names were also not mentioned in the report. But, the public prosecutor submits that, statements of the complainant and others were recorded, in which, the names of these petitioners are categorically stated. 4.

Hence, considering the above facts, this court opines that this is a not a fit case for granting anticipatory bail. 5.

Accordingly, the Criminal Petition is dismissed.

However, the petitioners can file a petition seeking for regular bail by surrendering themselves before the court below having the jurisdiction. The court below shall dispose of the bail

application on merits, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work. 6.

As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 16.03.2018 SS
