HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 15442 OF 2003 ORDER :

When the matter is taken up for hearing, it is noticed that the petitioners are challenging the action of the respondents in allotting them to work in underground Mine.

This Hon'ble Court was pleased to grant interim direction on 28.07.2003, directing the respondents to consider the representation of the petitioners dated 27.06.2003 and pass appropriate orders on merits. 3.

The Standing Counsel for the respondent-Corporation submitted that the representation of the petitioners, was considered by the respondents and appropriate orders were passed on 12.08.2003 and again they were posted to underground Mine. He further submits that the petitioners are not entitled to be posted to surface side of the respondent-company. If the petitioners are aggrieved by the rejection of the representation dated 12.08.2003, it is always open for them to challenge the same.

In view of the same, the Writ Petition is dismissed. 5.
