The representation filed by the petitioner which is placed on record reflects that he earlier filed W.P.No.31934 of 2010 on the same cause of action. However no averment is made about the filing of the said Writ Petition in the body of the present writ affidavit. Further, though the petitioner referred to the proceedings whereby pattas were allotted in the year 2009, he has not chosen to make the said patta

holders as parties to this Writ Petition.

The Writ Petition is therefore incurably defective and is accordingly dismissed.
