Smt. B.V. Lakshmi W/O B.V. Ramana, v. The State Of Telangana,Rep. By Its Principal Secretary,
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4377 OF 2017 O R D E R :
Heard Sri Manda Adam, learned counsel for the petitioner as well as learned Government Pleader for Finance & Planning. This Writ Petition is filed questioning the letter dated 18.01.2017 issued by the 2nd respondent Principal Secretary to Governor, wherein it has been stated that there was no order/direction from the Court to recover the compensation amount from the employment benefits of the 3rd respondent, who was dismissed from the post of Household Attendant, pursuant to the conviction handed down to him for the offence punishable under Section 138 of the Negotiable Instruments Act. It appears, the petitioner understood that the order is required to be obtained from the High Court, but however, since it is a matter pertains to recovery of money, the appropriate forum is the civil Court concerned.
Hence, the Writ Petition is closed by giving liberty to the petitioner to approach the civil Court and obtain appropriate orders. No costs.
Consequently, the miscellaneous Applications, if any shall also stand disposed of.
