CMA.No. 170 OF 2017 J U D G M E N T : {Per the Hon'ble Sri Justice Suresh Kumar Kait} The appellant being paternal grand father has filed the present Civil Miscellaneous Appeal against the order dated 25/01/2017 passed by the Principal District Judge, East Godavari district at Rajahmundry, in GOP.No. 430 of 2015.

2. Sri B. Sesi Bhushan Rao, learned counsel appearing on behalf of the appellant does not dispute the order dated 25/01/2017 as noted above, however, submits that Isukupathi Navya Kanth, aged about 13 years, who is studying tenth standard and his examinations schedule is from 21/03/2017 to 07/04/2017, therefore, till then the custody of the said child may not be disturbed.

3. Keeping in view the examinations schedule of the ward named above, in the interest of justice, we deem it

appropriate to extend the time to handover the custody of the aforesaid ward to the respondent, namely; Isukapati Rajeswari, wife of late Chandrahas, aged about 38 years, D.No. 13-8-12, Kotilingalapeta, Rajamahendravaram Urban, East Godavari district, till 15/04/2017.

4. In view of the above order, we do not consider it necessary to issue notice to the respondent.

5. With the above direction, this Civil Miscellaneous Appeal is disposed of at the admission stage. No order as to costs.

6. As a sequel, miscellaneous petitions if any, pending in this appeal shall stands closed.
