This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the inaction of respondent No.2 in pronouncing the orders in Appeal No.D/ 1580/ 2015, even after completion of pleadings and reserving the matter, as illegal and arbitrary and consequently, to direct respondent No.2 to pronounce orders in the said appeal.

Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue, appearing for respondent Nos.1 to 3, and perused the record. 3 .

The grievance of the petitioners in this case is that Appeal No.D/ 1580/ 2015, under Section 5 (5) of the Telangana Rights in Land and Pattadar Pass Books Act, 1971 read with Rule 21 of Telangana Rights in Land and Pattadar Pass Books Rules, 1989, is filed by the petitioners before respondent No.2/ Revenue Divisional Officer, Bhongir, Yadadri Bhongir District, aggrieved by the proceedings, dated 07.03.2015, of respondent No.3/ Tahsildar, Mothkur Mandal. Though respondent No.2 has heard the arguments and reserved the matter, he did not pronounce the orders in the appeal yet.

In the course of submissions, it is brought to the notice of this Court that the Revenue Divisional Officer, who reserved the appeal, is transferred. It is pertinent to state that the pending

appeal is of the year 2015. It is required to be disposed of expeditiously.

Therefore, the transferee respondent No.2/ Revenue Divisional Officer, Bhongir, Yadadri Bhongir District, shall reopen the appeal, hear it afresh and dispose of the same in accordance with law, as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of at the stage of admission.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ______________________ Dr . SHAMEEM AKTHER, J May 01, 2019.
