HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY & HON'BLE SRI JUSTICE M.S.K. JAISWAL Date : 19-07-2017 Between:

Sanivada Lakshmi .. Petitioner and The State of Andhra Pradesh, Represented by its Chief Secretary Secretariat Buildings, Velagapudi, Amaravathi and others .. Respondents Counsel for petitioner : Sri V.V.N. Narasimham Counsel for respondents : Advocate-General (AP) The Court made the following:

CVNR,J & MSKJ,J ORDER: (per Hon'ble Sri Justice C.V. Nagarjuna Reddy) Detention order dated 31-3-2016 whereby one Sanivada Govindu, s/o. Appalanaidu (for short "the detenu") was detained for a period of one year, is under challenge in this Writ Petition. The learned Counsel for both the parties submitted that as the period of detention has expired long back, the cause in the Writ Petition does not survive for adjudication.

Sri V.V.N. Narasimham, learned Counsel for the detenu however submitted that his client was earlier detained under a separate detention order on 17-12-2015 and that as the same was not approved, the impugned detention order has been passed on 31-3-2016. He has requested that a direction may be issued to the respondents to treat the period between 17-12-2015 and 31-3-2016 as the period under remand. In our opinion, as the aforementioned period is not the subject matter of the present Writ Petition, no direction as requested by the learned Counsel, can be granted. However, it is permissible for the detenu to move the appropriate Court for claiming the aforementioned relief. Subject to the liberty given to the detenu as above, the Writ Petition is disposed of as infructuous.

As a sequel to the disposal of the Writ Petition, WPMP No.3886 of 2017 is disposed of as infructuous.
