ORDER:

This Writ Petition is filed for a mandamus to declare the action of the respondent in not transferring the authorisation pertaining to fair price shop No.05014 of Chinnamandava village, Chinthakani Mandal, Khammam District, standing in the name of the petitioner's father, in favour of the petitioner, as illegal and arbitrary.

In the counter affidavit filed by the respondent, it is inter alia stated that the petitioner's father who was the permanent fair price shop dealer of the shop in question has died and that in the absence of any provision in existence, the request of the petitioner for transfer of the authorisation in his name could not be accepted.

At the hearing, there is no representation for the petitioner.

The learned Government Pleader for Civil Supplies (TS), on instructions, submitted that during the pendency of the Writ Petition, the respondent has appointed a third party as the permanent dealer of the fair price shop in the year 2010.

In the light of this subsequent development, the cause

in the Writ Petition does not survive for adjudication. The Writ Petition is accordingly dismissed as infructuous. As a sequel to the dismissal of the Writ Petition, interim order dated 26-2-2009 is vacated and WPMP No.4866 of 2009 and WVMP No.2323 of 2009 are disposed of as infructuous.
