THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE MRS. JUSTICE ANIS APPEAL SUIT No. 718 OF 2015 J U D G M E N T: (per Hon'ble Sri Justice Nooty Ramamohana Rao) Smt. K. Satyavathi, W/o K.S. Raju filed this Appeal calling in question the correctness and validity of the judgment and decree rendered in O.S.No. 55 of 2003 on the file of the V Additional District & Sessions Judge, Ranga Reddy at L.B. Nagar.
Initially, this Appeal has been preferred engaging the services of Sri M. Govind Reddy, Bar-at-law, but however, the learned Barrister filed a memo on 20.11.2015 bringing it to the notice of the Court that the appellant/party has taken the complete record and no objection from him. Therefore, he ceased to act on her behalf from 20.11.2015.
Smt. K. Satyavathi is present in the Court today. She also filed a sworn affidavit before us bringing out that she has settled the dispute with the respondents out of Court and that she has no further cause against them and hence, she wishes to withdraw the present Appeal as she does not want to pursue the same in view of the settlement arrived at between the parties. The affidavit presented in the Court hall today is taken on record and in view of the statement made by Smt. K. Satyavathi in the Court today, we consider that this Appeal should be dismissed as withdrawn.
Learned counsel for Respondents 7 and 8 is also present and he has also been served with the copy of the affidavit filed by Smt. Satyavathi. He also supports the view that the matter has been settled out of the Court amicably by the parties. Therefore, we dismiss this Appeal as withdrawn, but however, without costs. Smt. Satyavathi has presented a photocopy of the Aadhar card bearing No. 3550 2331 8372 issued to her by the Government of India to satisfy us about her identity and the same is taken on record.
Consequently, the miscellaneous Applications, if any shall also stand dismissed.
