HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12017 of 2015 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the respondent in not paying the time scale to the petitioner in pursuance of the order dated 15.6.2012 ,as arbitrary, illegal, violative of principles of natural justice and Articles 14 and 21 of the Constitution of India., and consequently, to direct the respondent to continue to pay the same every month besides the arrears of salary. 2.
Heard Sri P.B. Vijaya Kumar, learned Counsel for the petitioner and Sri P. Sriramulu Naidu, learned Standing Counsel for the respondent.

It has been contended by the petitioner that he was appointed as an attender in the respondent-University in the year 1999 on contract basis, and during the period from 2006 to 2009, the petitioner was disengaged and subsequently, he was re-engated in November, 2009 and since then, he has been discharging his duties continuously without any complaints. It has been further contended that vide order dated 15.6.2012, the respondent decided to extend time scale to the petitioner and accordingly, time scale was extended to the petitioner for three months and thereafter, it was not extended.
Challenging the said action of the respondents, the present writ petition is filed.

The learned Counsel for the petitioner contends that appropriate orders may be passed directing the respondent to extend minimum time scale of pay to the petitioner in terms of the order dated 15.6.2012.

This Court having considered the above submission is of the view that this writ petition can be disposed of directing the respondent to extend minimum time scale of pay to the petitioner.

Accordingly, the Writ Petition is disposed of directing the respondent to extend minimum time scale of pay to the petitioner in terms of the order dated 15.6.2012 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. Consequently, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
