THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.2510 of 2016 ORDER:
The present Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. aggrieved by the order dated 28.09.2016 passed in CFR No.5449/2016 in C.C.No.265 of 1997 by the V Additional Junior Civil Judge, Guntur, whereby the learned Judge rejected the application filed by the petitioner to dispense with her personal attendance.
Heard and perused the material on record.
As seen from the material on record, petitioner-A.8 is facing charges for the offence punishable under Section 494 of the Indian Penal Code. Since the petitioner is aged 78 years, she made the application seeking dispensation of her personal appearance before the trial Court and sought permission for representation through a Special Vakalat holder to receive document and to answer the charge. Questioning the rejection of said application, present revision is filed.
Having regard to the facts and circumstances of the case and taking into consideration the fact that the petitioner is aged about 78 years and suffering with old age ailments, the presence of the petitioner before the trial Court on every date of adjournment is dispensed with except on the dates required by the Court. However, she shall answer the charge and be represented through a Special Vakalat Holder.
Accordingly, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending in this revision, if any, shall stand closed.
