HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 17079 of 2016 ORDER:
Heard learned counsel for the petitioners, Government Pleader for Municipal Administration and Urban Development, Government Pleader for Home, Government Pleader for Revenue and Sri Pasam Krishna Reddy, Standing Counsel for G.H.M.C. There is no necessity to put the unofficial respondents on notice as this Court is not venturing to adjudicate the issue on merits.
The present writ petition came to be filed with the following prayer:
"Issue writ of mandamus declaring the action of respondent Nos.1 to 5 in not considering the petitioners' representation dated 17.05.2016 as illegal, arbitrary and violative of principles of natural justice; and consequently direct respondent Nos.2 and 3 to demolish the community hall, which was illegally constructed by respondent Nos.6 and 7 in S.V.Colony, Bairamalguda Village, Saroornagar Mandal, Ranga Reddy District; and also direct respondent Nos.4 and 5 to resume the land i.e. house bearing Nos.7-2-31/11 to 55 (44 plots), H.No.7-2-31/74 to 84 (10 plots, H.No.7-2-31/113 to 130 (17 plots) and H.No.7-2-31/175 to 226 (51 plots) of Bairamalguda Village, Saroornagar Mandal, Ranga Reddy District and to allot the same to the petitioners."
A perusal of the material on record would show that the petitioners made a representation to the respondent authorities
stating that respondent Nos.6 and 7 have illegally converted the park into their community hall thereby causing disturbance to the villagers.
Having regard to the facts and circumstances of the case and without going into the merits of the case, the present writ petition is disposed of, directing respondent No.5 to dispose of the representation dated 17.05.2016 made by the petitioners, in accordance with law, as expeditiously as possible, preferably within a period of two (02) months from the date of receipt of a copy of the order, if the same is still pending consideration after hearing all the concerned. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
