THE HON'BLE SRI JUSTICE M.S.K.JAISWAL WPMP No.51500 of 2015 in WP No.17044/2004 & WRIT PETITION No.17044 of 2004 ORDER:

This writ petition is filed by the petitioner seeking Writ of Mandamus declaring the proceedings No.HRO:PRS:2004-05/951, dated 23.08.2004 issued by the 3rd respondent, as illegal and consequently direct the respondents to treat the petitioner as pension optee in terms of his letter of pension option dated 30.09.1994 and to make necessary corrections in the records of the Bank. When the matter came up for hearing, both parties filed WPMP.No.51500/2015 stating that the matter has been settled between both parties and the respondent Bank has agreed to pay pension based on the first option given by the petitioner, and requested to record compromise and dispose of the matter. In view of the above, WPMP No.51500/2015 is ordered, the compromise is recorded, and the Writ Petition is accordingly disposed of, in terms of the compromise arrived at between the parties. In the circumstances, there shall be no order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
