Petitioner filed O.A.No.1764 of 2013 seeking declaration of the action of the respondents in not considering his claim for appointment on compassionate grounds, on the ground that the services of father of the petitioner were not regularized and placed reliance on the orders of the Government in G.O.Ms.No.118, dated 18.08.1999 to grant the relief of appointment. According to the petitioner his father worked as NMR in the 4th respondentMunicipality, having been appointed in the year 1988 and while working in the said capacity he died. Therefore, in accordance with the orders of the Government in G.O.Ms.No.118, he is entitled for consideration for provision of appointment on compassionate grounds.

Learned Government pleader produced proceedings of Municipal Commissioner, Tandoor Municipality dated 21.03.2013, wherein by assigning due reasons, the claim of the petitioner for providing employment on compassionate grounds in accordance with G.O.Ms.No.118 was rejected.

As the request of the petitioner for provision of appointment on compassionate grounds was rejected by a speaking order, the cause in the writ petition does not survive.

Writ Petition (Tr) is accordingly dismissed. However, it is open to the petitioner to avail the remedies as available in law, if he is so advised, aggrieved by the order of the Municipal

- 3 - Commissioner dated 21.03.2013. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition (Tr) shall stand closed.
